Performance Management and the Law Carlos M Garcia   Introduction: Within an organization there are many different ways to follow and obeyed employees regulations laws. These laws are governed by federal, state and judicial legislation, made to avoid lawsuits, discrimination, and to equalize bargaining power between employers and employees. According to (Smither, J. W., London, M., 2009), information would be required based on employees performance management to take further action either against or in favor of the individual. It is legally allowed to support supervisors/ managers and the organization in case of legal action from an employee. To approach these situations, the organization should follow certain steps to be fair to its employees and meet the U.S. federal regulations laws for employee personnel actions. To minimize the risk of employee-initiated litigation, employers must develop a checklist with the points necessary to ensure compliance with fair, consistent and legally sound performance evaluation systems. Such as, Inform employees in advance of performance evaluation standards. When hiring a new employee or adopting new standards, supervisors must update job descriptions and performance assessment forms, and copies should be given to all affected employees. Document all performance problems on a regular basis and on appropriate evaluation or gradual disciplinary action forms it should be very important for the records. An accurate format for conducting the evaluations allows the most complete and accurate recording of the information. Informality, on the other hand, can lead to discrimination claims. Federal and state laws prohibit discrimination in the workplace under Title VII of the Civil Rights Act (Miller, F., n.d.). Also, give employees meaningful feedback because a vague, generalized or subjective assessments can lead to litigation. For example, when bosses tolerate an employee with performance problems for months and then suddenly give him a negative assessment and dismiss him, the employee can claim that the action was arbitrary or discriminatory and may be able to show that he was not given an opportunity to improve. Therefore, it should be essential to train supervisors in evaluating employee performance and how to manage the companys assessment system. Every organizations policies and procedures must comply based on federal and state laws related to employees, which allows equal employment opportunity, sexual harassment, safety, and much more. It is the organizations responsibility to provide every employee the policies and procedures related to federal laws such as the standards of conduct, nondiscrimination, benefits, etc. At Comcast, every employee must have a policy pocket book with them at all the time, and every year they need to review the handbook and acknowledge it. The organization must maintain new and old employees informed about U.S. federal regulation equally to all employees. A performance evaluation based on invalid outcomes can lead to adverse impacts, such as, discrimination, involve personal issues, and other situations that can lead to legal actions. For the same reason, legally defensible performance evaluation system must be implemented. Therefore, evaluators must personally know employees performance. The system adverse impact it will always exist some way or another, but it could minimize by continuous system reviews to keep a positive performance appraisal and fairly to all employees equally. Based on (Smither, J. W., London, M., 2009), by including contextual performance as part of the job performance criteria will actually reduce adverse impact in selection since the predictors of contextual performance have little adverse impact (Smither, J. W., London, M., 2009), There are different methods to evaluate performance management within an organization. Since it is not an easy task to assess the performance management to all individuals using criteria of fairness and justice, and at the same time stimulating them (Gilliland, S. Langdon, J., 1998). Therefore, to ensure fairness in the performance process: The organization should develop a system where all employees meets the needs as customers, this way the evaluation will reflect how customers would rate them, if employees do not accept the performance appraisal outcomes the system will not meet the needs and it will result in a conflict (Gilliland, S. Langdon, J., 1998). The opportunity to evaluate managers and supervisors will give employee a sense of fairness. It will help to impove the organization on various different aspect, it will help to identify any issues within the workplace related to sexual harassment, discrimination, favoritism, etc. Value employees opinions and let them participate in situations where the individual can be valued for his/ her performance. Conclusion Therefore, in order to achieve the objectives proposed by the organizations, they must have a suitable staff to compete in the demanding business environment. Therefore, it is important to express that the performance evaluation plays a fundamental role in the companies since through it is possible to determine which is more competent personnel to carry out the activities inherent to the positions. It can be concluded that when considering the human resource as a decisive factor and an important asset, well-defined performance evaluation policies must be implemented to detect failures within organizations, in order to achieve favorable changes in their structure and performance, and maintain a relationship of justice and fairness with all workers. Hamlet and Play

Hamlet Essay The act of revenge never fails to accomplish Shakespeare’s goal of keeping the audience in their seats. Hamlet, William Shakespeare’s most well written play carries the theme of revenge or redemption throughout the play. Redemption is defined to be as the desire to undo an injury or a wrongdoing. Many characters felt that they needed to redeem themselves however in doing so, they ended up facing death. For some characters, revenge had sprouted from their urges to redeem themselves. Revenge is defined as the desire to repay an individual for their injury or wrongdoing.A famous American novelist, John Irving has mentioned in work The World According to Garp, that it is a life-redeeming work in which everybody dies. Hamlet, Shakespeare’s most unique play follows in-line with Irving’s idea which is seen through the actions of Hamlet, Laertes and Gertrude. Hamlet, the protagonist of the play was greatly affected by the death of his father, King Ham let who he sought for revenge throughout the play. During the beginning of the play, Hamlet was very distressed at the fact that his father had died. He was very troubled at the fact that his mother Gertrude had remarried Claudius so quickly.Hamlet felt that his mother had betrayed and abandoned his father for another man. After Hamlet’s altercation with the King Hamlet’s ghost, Hamlet raged in anger against Claudius for killing his father. Hamlet felt that he needed to redeem his father so he sought his path of revenge by planning on killing Claudius. Hamlet also tried to redeem himself with Ophelia. Hamlet has acted very rudely and crazy in front of Ophelia where he said, â€Å"Or, if thou wilt needs marry, marry a fool, for wise men know well enough what monsters you make of them† (3. 1. 139-141). However, by the time Ophelia died, Hamlet poured his heart out saying that: Swounds, show me what thou'lt do. Woo’t weep? Woo’t fight? Woo’t fa st? Woo’t tear thyself? Woo’t drink up eisel, eat a crocodile? I’ll do ’t. Dost thou come here to whine, To outface me with leaping in her grave? Be buried quick with her? —and so will I. (5. 1. 252-258) Hamlet realizes how much he actually loved Ophelia and he shows that he will be willing to do anything to redeem himself for the way he acted towards Ophelia before. During the scene at the churchyard, Laertes and Hamlet get into an altercation in Ophelia’s grave however, Hamlet after feels â€Å"very sorry† for his actions towards Laertes (5. . 80). By the end of the play, Hamlet gives a formal apology to Laertes, which he accepts. This signifies that as the play progress and as Hamlet makes mistakes, he attempts redeem himself in the way he was acting crazy. Hamlet wanted to come back to his usual self but at the same time he still wanted seek his revenge against his father. By the end of the play, Claudius does die and Hamlet fulfi lls his goal of seeking redemption just before his death. Laertes is an explosive and hotheaded character who got angry when he found out from Claudius that it was Hamlet who killed his father, Polonius.Claudius plans out a devious plan for Laertes to kill Hamlet during fencing. Claudius shows his true character when he encourages Laertes to choose a sharp sword and to â€Å"[r]equite [Hamlet] for [his] father† (4. 7. 136). However, by the end of the play Laertes realizes that by going against Hamlet, he is doing a wrong thing. Even after betraying Hamlet, Laertes redeems himself by exposing that the king is at fault for events that took place. He finally asks for Hamlet’s forgiveness, which Hamlet accepts.This signifies that even though he fulfilled Claudius’ wishes of killing and betraying his friend Hamlet; he still redeemed himself by telling Hamlet the truth about Claudius. By the end of the play, Laertes faced death while he was seeking redemption. As per Hamlet, Gertrude was seen as a mother who had betrayed her previous husband, King Hamlet by marrying Claudius a few months after King Hamlet’s death. Gertrude did not take Hamlet’s feeling into consideration after remarrying with Claudius showing that Instead, she forces Hamlet to accept Claudius as his father, which shows that she only thinks about herself; she is selfish.Gertrude wasn’t hesitant in telling Claudius that it was Hamlet who killed Polonius. She was willing to betray her own son by further convincing Claudius that Hamlet was mad. By doing so, Claudius began planning on â€Å"sending [Hamlet] away†, which Gertrude agreed to (4. 3. 8). However, it seems that by the end of the play Gertrude has a realization this entire time it was Claudius who was really against her and not Hamlet. She dies by crying out â€Å"Oh, my dear Hamlet! † (5. 2. 305). It seems that Hamlet forgives her because instead of ignoring her death he was furious and h e wanted to know he had killed her.Gertrude redeems herself by the end of the play but unfortunately she was killed by the end of the play. Fortinbras, the son of Old Fortinbras had a goal of attaining all the lands that was lost against King Hamlet. He aims to redeem the death of his father and Norway’s honour by taking over Denmark. Even though Fortinbras was seeking redemption, he did not face the same consequences of death like many characters within Hamlet. Instead, by the end of the play Fortinbras â€Å"embrace[s] [his] fortune† by taking over Denmark even though may not have wished to take over Denmark in the way he did and that is with sadness over the many deaths.Fortinbras is a character whose life was surrounded by redemption did not end with death. William Shakespeare’s best play, Hamlet has one of the most disastrous tragedies in all of English literature. Throughout the play, a common theme of redemption ran through the play. Characters sought ven geance and redemption for their wrongdoings whereas many of them faced the consequences of death doing so. How Sarin Nerve Gas Works (And What to Do If Exposed)

Sarin is an organophosphate nerve agent. It most commonly is considered a nerve gas, but it mixes with water, so ingestion of contaminated food/water or liquid skin contact also are possible. Exposure to even a small amount of Sarin may be fatal, yet treatments are available that may prevent permanent neurological damage and death. Heres a look at how it works and how exposure to Sarin is treated. Sarin gets its name from its discoverers: Schrader, Ambros, Rà ¼diger, and Van der Linde. As a weapon of mass destruction and chemical weapon, sarin is identified by NATO designation GB. The production and stockpiling of sarin was forbidden by the Chemical Weapons Convention of 1993. Pure Sarin is colorless, odorless, and has no flavor. It is heavier than air, so Sarin vapor sinks into low-lying areas or toward the bottom of a room. The chemical evaporates in air and mixes readily with water. Clothing absorbs Sarin and its mixtures, which can spread exposure if contaminated clothing is not contained. Its important to understand you can survive a low concentration of Sarin exposure as long as you dont panic and do seek medical attention. If you survive initial exposure, you may have several minutes to several hours to reverse the effects. At the same time, dont assume you are in the clear just because you survived initial exposure. Because effects may be delayed, its important to get medical attention. How Sarin Works Sarin is a nerve agent, which means it interferes with the normal signaling between nerve cells. It acts in much the same way as organophosphate insecticides, block nerve endings from allowing muscles to stop contracting. Death may occur when the muscles controlling breathing become ineffective, causing asphyxiation. Sarin acts by inhibiting the enzyme acetylcholinesterase. Ordinarily, this protein degrades acetylcholine released at the synaptic cleft. The acetylcholine activates nerve fibers that cause muscles to contract. If the neurotransmitter is not removed, the muscles dont relax. Sarin forms a covalent bond with the serine residue at the active site on the cholinesterase molecule, making it unable to bind to acetylcholine. Symptoms of Sarin Exposure Symptoms depend on the route and intensity of exposure. The lethal dose is incrementally higher than the dose producing minor symptoms. For example, inhaling an extremely low concentration of Sarin may produce a runny nose, yet a very slightly higher dose may cause incapacitation and death. The onset of symptoms depends on dose, usually within minutes to hours after exposure. Treating Sarin Victims Although Sarin can kill and cause permanent damage, individuals who suffer mild exposure usually recover completely if given immediate treatment. The first and most important action is removing Sarin from the body. Antidotes to Sarin include atropine, Biperiden, and pralidoxime. Treatment is most effective if given immediately, but still helps if some times passes (minutes to hours) between exposure and treatment. Once the chemical agent is neutralized, supportive medical care is helpful. What to Do If You Are Exposed To Sarin Do not administer mouth-to-mouth resuscitation to a person exposed to Sarin, since the rescuer can be poisoned. If you think you have been exposed to Sarin gas or Sarin-contaminated food, water, or clothing, its important to seek professional medical attention. Flush exposed eyes with water. Clean exposed skin with soap and water. If you have access to a protective respiratory mask, hold your breath until you can secure the mask. Emergency injections typically are used only if symptoms of severe exposure occur or if the Sarin is injected. If you have access to injectables, be sure to understand when to use/not-use them, since the chemicals used to treat Sarin come with their own risks. Famous novels like Bridget Jones’ Diary, The Notebook, The Lord of the Rings, and let’s not forget Harry Potter series are also successfully made into movies. But nowadays, there is this new phenomenon of The Hunger Games trilogy that often discussed. The cast directly becomes new idols of this generation.
